SPORT HYPE TERMS & CONDITIONS

By purchasing a custom song from Sport Hype, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
1. CUSTOM SONG SERVICE
Sport Hype creates personalized songs based on information submitted by the customer. This may include player names, team names, jersey numbers, positions, accomplishments, interests, personality traits, favorite things, catchphrases, stories, chants, and other requested details.
The customer is responsible for providing accurate information and ensuring they have permission to submit any names, photographs, logos, trademarks, or other materials provided to Sport Hype.
2. CUSTOMER USAGE RIGHTS
Upon completion and full payment for the custom song, the customer receives the right to use the delivered song for personal, team, promotional, social media, highlight video, sporting event, walk-up music, entrance music, celebration, and other lawful purposes consistent with these Terms.
This includes using the song in player highlight videos, team videos, social media posts, sporting events, personal videos, websites, and similar applications.
These usage rights do not make the customer a songwriter, composer, producer, or publisher of the song and do not transfer writer, publishing, or other royalty rights to the customer.
3. SONGWRITING, COMPOSITION & AUTHORSHIP
Sport Hype and/or its designated creators are responsible for the creative production of the song, including its lyrics, composition, arrangement, production, and final recording.
Purchasing or commissioning a custom song does not designate the customer, athlete, player, team, parent, coach, or any person named or referenced in the song as a songwriter, composer, producer, or contributing author unless otherwise expressly agreed to in writing.
Providing names, facts, stories, phrases, preferences, ideas, themes, chants, or other information for use in the song does not, by itself, establish songwriting or authorship credit.
4. WRITER, PUBLISHING & RELATED ROYALTIES
Purchasing a custom Sport Hype song does not entitle the customer to songwriter, composer, publishing, performance, mechanical, or other writer-related royalties.
Any songwriter, composer, publishing, performance, mechanical, or similar royalties that may legally arise from the authorship or composition of the song remain with Sport Hype and/or the applicable credited writers or rights holders.
The customer’s right to use the completed song under these Terms does not constitute an assignment of songwriter or publishing rights.
5. AI-ASSISTED CREATION
Sport Hype may use artificial intelligence, digital production tools, music-generation technology, virtual instruments, software, and other creative tools as part of its songwriting, production, editing, mixing, mastering, or creative process.
By purchasing a Sport Hype song, you acknowledge and agree that these technologies may be used in creating your song.
Because laws and policies concerning AI-assisted creative works continue to develop, Sport Hype does not guarantee that any particular element of a song will independently qualify for copyright protection.
6. CUSTOMER-SUBMITTED CONTENT
You represent that you have the necessary permission or authority to provide Sport Hype with any names, photographs, logos, trademarks, slogans, chants, written materials, or other content submitted as part of your order.
You grant Sport Hype permission to use these materials as reasonably necessary to create your custom song, artwork, and related materials.
You agree not to knowingly submit materials that infringe another person’s intellectual property, privacy, publicity, or other legal rights.
7. MINORS
Sport Hype songs may be created for youth athletes.
If you submit the name, photograph, likeness, or other identifying information of a minor, you represent that you are the minor’s parent or legal guardian, or that you otherwise have appropriate authorization to provide that information and request the creation of the song.
You authorize Sport Hype to use the submitted information as reasonably necessary to create and deliver the purchased product.
If you decide to have a song involving a minor posted publicly on the Sport Hype YouTube channel, you also represent that you have the authority to authorize the public use of the minor’s submitted name, likeness, and approved information in connection with that video.
8. OPTIONAL YOUTUBE POSTING
Sport Hype gives customers the option to have their completed custom song posted publicly on the Sport Hype YouTube channel.
YouTube posting is optional and is not automatically included with the purchase of a custom song.
If you decide to have Sport Hype post your song on YouTube by selecting “Yes” on your song submission form, you authorize Sport Hype to upload and make the completed song publicly available through the Sport Hype YouTube channel according to these Terms.
If you select “No,” Sport Hype will not publicly post your song to the Sport Hype YouTube channel.
9. YOUTUBE VIDEO INFORMATION
If you decide to have Sport Hype post your song on YouTube, the video may include your completed song, song title, player or team name, approved cover artwork, and other information associated with your order.
Sport Hype may determine the title, description, thumbnail, artwork, tags, formatting, and other presentation elements used for videos uploaded to its YouTube channel.
The purpose of the YouTube upload is to provide an easy way for customers, players, teams, friends, family, coaches, and fans to listen to and share the completed song.
10. YOUTUBE SHARING & CUSTOMER USE
If you decide to have Sport Hype post your song on YouTube, you may share the public YouTube link with players, teammates, coaches, friends, family, fans, or others.
Having your song posted on YouTube does not replace the delivered copy of your song and does not change the usage rights included with your purchase.
You may continue using your delivered song according to the customer usage rights provided elsewhere in these Terms.
11. YOUTUBE MONETIZATION & REVENUE
If you decide to have Sport Hype post your song on YouTube, you acknowledge that videos uploaded to a Sport Hype-owned or Sport Hype-operated YouTube channel may be monetized by Sport Hype.
Sport Hype retains 100% of advertising revenue, YouTube revenue, platform-generated revenue, sponsorship revenue, or other revenue generated through Sport Hype’s YouTube channel or accounts.
Purchasing, commissioning, inspiring, or being featured in a custom song does not entitle the customer, athlete, player, parent, coach, team, or other person to a share of revenue generated through the Sport Hype YouTube channel.
12. YOUTUBE REMOVAL
If you decide to have Sport Hype post your song on YouTube, you may later request that Sport Hype remove the video from its YouTube channel.
Sport Hype will make reasonable efforts to honor legitimate removal requests within a reasonable period.
Removal of the YouTube video does not affect your ability to continue using your delivered copy of the custom song according to the usage rights included with your purchase.
Any revenue generated by the YouTube video before its removal, as well as revenue attributable to activity occurring before removal but reported or paid afterward, will remain with Sport Hype.
13. YOUTUBE PLATFORM POLICIES
YouTube is a third-party platform that Sport Hype does not own or control.
Sport Hype cannot guarantee that a video will remain available indefinitely or that YouTube will not modify, restrict, demonetize, or remove a video according to its own policies.
If you decide to have your song posted on YouTube, you acknowledge that availability and performance of the video are also subject to YouTube’s rules, systems, and policies.
Sport Hype does not guarantee any particular number of views, likes, comments, shares, subscribers, impressions, revenue, or other results from posting your song.
14. FINAL APPROVAL
Customers are responsible for reviewing their completed song and identifying any significant errors in names, jersey numbers, team information, lyrics, or other requested details during the applicable approval or revision process.
Once the final song has been approved, Sport Hype may use that approved version for final delivery and, if the customer selected the YouTube option, the Sport Hype YouTube upload.
Customers should carefully review names, numbers, and other important information before approving the final version.
15. REVISIONS
Sport Hype will make reasonable efforts to create the song based on the information and preferences submitted by the customer.
Because music and other creative work are subjective, purchasing a custom song does not guarantee that every creative choice will match the customer’s personal preference.
Any revisions included with a customer’s purchase will be subject to the revision policy presented with the applicable Sport Hype product or offer.
Requests to correct reasonable errors in names, jersey numbers, or information that was provided correctly by the customer will be handled according to Sport Hype’s applicable revision policy.
Requests that substantially change the original information, concept, musical style, lyrics, theme, or direction after creation has begun may be considered a new project or additional revision and may require an additional fee.
16. REFUNDS & CUSTOM WORK
Sport Hype songs are personalized digital products created specifically for each customer.
Because work may begin shortly after an order is submitted and the resulting product is customized for that customer, payments may become non-refundable once creation has begun.
Sport Hype may, at its discretion, issue refunds, credits, revisions, or other accommodations when appropriate.
Nothing in this section limits any consumer rights that cannot legally be waived under applicable law.
17. PROMOTIONAL USE BY SPORT HYPE
Sport Hype may request permission to display, play, share, or feature completed songs and associated approved materials on its website, social media accounts, portfolio, advertisements, demonstrations, and other promotional materials.
If you decide to have your song publicly posted on the Sport Hype YouTube channel, you acknowledge that the song and associated approved materials will be publicly accessible and may also be shared or referenced by Sport Hype for purposes related to promoting the Sport Hype service.
If a song concerns a minor, the person placing the order represents that they have the appropriate authority to grant any permissions provided to Sport Hype.
18. THIRD-PARTY PLATFORMS
Sport Hype does not own or control third-party platforms such as YouTube, Instagram, Facebook, TikTok, or other social media and digital services.
If you choose to upload, post, or otherwise use your delivered song on a third-party platform, your use may also be subject to that platform’s own terms, policies, copyright systems, and content requirements.
Sport Hype is not responsible for platform outages, policy changes, automated copyright claims, processing delays, content removals, account changes, or other actions taken by third-party platforms.
19. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Sport Hype will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from the creation, use, publication, sharing, removal, or performance of a custom song.
Sport Hype’s total liability relating to a customer’s purchase will not exceed the amount the customer paid Sport Hype for the applicable custom song, except where such a limitation is prohibited by law.
20. CHANGES TO THESE TERMS
Sport Hype may update these Terms & Conditions from time to time.
The terms applicable to an order will generally be the terms presented to and accepted by the customer at the time of purchase, except where changes are required by law or separately agreed to by the parties.
21. ACCEPTANCE OF TERMS
By completing your purchase and selecting the required Terms & Conditions acknowledgment at checkout, you confirm that you have read, understood, and agreed to these Terms & Conditions.
If you later select “Yes” to the YouTube option on your song submission form, that selection confirms your decision to have the completed song publicly posted on the Sport Hype YouTube channel and authorizes Sport Hype to use the song and associated approved materials for that YouTube upload according to the applicable provisions of these Terms.
